Since the Covid-19 outbreak, the United States immigration procedures have seen constant change. The newest immigration proposals as announced by the Biden Administration aim to create an eight-year path to citizenship for an estimated number of 10.5 million unauthorized immigrants. it will also promote legal immigration, family sponsorship, temporary work visas, and citizenship. Recent immigration laws would oversee changes in the following areas;

Providing a pathway to citizenship and strengthening labour protection

  • The bill aims to promote legal immigration by allowing undocumented individuals to apply for temporary legal status, and can apply for a permanent visa after 5 years if the requirements are met.
  • It aims at reuniting families by eliminating long waiting periods, clearing backlogs, and increasing per-country visa caps. It also explicitly includes permanent partnership and eliminating discrimination
  • The new bill includes the NO BAN Act that addresses discrimination against religion and limits the president’s authority to act on it in the future. It also allowed for an increase in the diversity visas from 55,00 to 80,000.
  • The bill looks to grow the economy by eliminating unnecessary employment hurdles and creating pilot programs to encourage regional economic development
  • Protect workers from exploitation and violations

Changes to H1-B Work Visas

The H1-B visa is a non-immigrant visa that allows foreigners to be employed in US companies in occupations that require technical or theoretical expertise

The proposals stated that the government will continue to modify the H1-B visa program to encourage and boost professional employer-employee. Other forecasted changes are

  • Redefinition of the H-1B employer-employee relationship

make provision for permanent work for spouses of H-1B visa holders

  • Establish a new site visit standards for employers
  • Clarify that if there are major changes to employment, such as workplace location, an H
  • Clarify that regulations for Fes -1 students who are waiting for the status to be changed to H-

Prioritize smart border controls

The bill would;

  • Develop existing border resources with the latest technology to enhance screening processes and detect illicit activities
  • It provides funding to maintain, manage and protect border communities
  • The bill enhances the ability to stop and persecute criminal acts, smuggling and trafficking networks that exploit migrants

The address root cause of migration

  • The bill addresses the reason for migration, it aims to increase assistance to Guatemala, El Salvador, and Honduras in an attempt to reduce corruption and poverty that causes people to leave their home country
  • It protects vulnerable individuals, expands training for immigration judges, improves technology for immigration courts
  • The bill supports asylum seekers and other vulnerable individuals by removing the usual one-year deadline for filing asylum claims. It provides funding to improve assistance.

The Bidden Administration’s new policies seek to provide for a more defined pathway for international STEM (Science, technology, engineering, and math) international talent.

  • The announcement of 22 new study fields to the STEM optional practical training (OPT) program
  • Allowing F-1 students earning Bachelors, Masters, and Doctorates in certain STEM fields to remain in the united states for up to 36 months to complete optical practical training
  • Allowing J-1 Exchange visitors in the pre-doctoral STEM program to qualify for an extension of up to 36 months
  • Support national interest waivers for certain immigrants with exceptional skills and talents
